DivorceThere are two parts to a divorce--property division and parenting plans. The latter only applies if there are children involved. Even if there are no children, the couple will still have property in common. This can include real property, like houses or boats. It can also include pension funds, savings, 401(k) plans and other personal property. I work with my clients to help them divide their property in a way that works for them. Child Custody, Visitation, and Child SupportIf there are children involved, the couple must devise and implement a parenting plan. They must determine who gets physical and legal custody. The usual arrangement is to have one parent get primary physical custody, while legal custody is shared jointly. The non-custodial parent gets reasonable visitation rights and in many instances pays child support. Although you and your spouse are no longer together, you still have to work together to raise your children. Divorce can be especially hard on children, so I do my best to minimize the impact it has on them. Domestic ViolenceI recognize that there are times when working with your spouse is impossible.
